Medical malpractice - Improper handling of postpartum hypertension resulting in a stroke. Plaintiff, age 38, suffered fr...om severe preeclampsia during her pregnancy. After the delivery of her child, she was transferred to a regular postpartum floor where she was checked by the nursing staff once an hour despite the fact that her blood pressure continued to rise. Her attending physician (Dr. Toig) left the hospital shortly after the delivery and plaintiff was examined by two different residents and despite symptoms which included vomiting, headaches, and epigastric pain she was only given pain medication and magnesium sulfate. Thirteen hours after the delivery, plaintiff suffered a stroke which paralyzed her left side.

Before the stroke, plaintiff was an administrative assistant earning $38,000. As a result of the stroke, she now must wear a brace on one left and walks with a cane. She was unable to return to work.

Plaintiff claimed that her attending physician (Dr. Toig) failed to leave clear instructions concerning her postpartum care and that she was not properly evaluated and treated for the symptoms which were present after the delivery.

Outcome: Settled for $6.5 million, $5.5 million of which was paid by the hospital. more details
